Governance

You may often hear people reference “The Documents”.  They are a set of documents that cover the legal organization of the homeowners association and standards set for the community.  Click here for the complete documents book.  You can click here for a Quick Reference Guide to the documents. 

The legal documents within the document book are the Declaration of Restrictions and Covenants, By-Laws, and Articles of Incorporation.  Also within the document book is the Community Standards document.  The Declarations and Community Standards can be used as reference documents that give specifics for the items in the Quick Reference Guide.  It is highly recommended that all homeowners read through all documents in the document book and then the Quick Reference Guide can be used as reminders.

In 2000 and 2001 the Declarations were amended.  Click here to see the specific amendments.   These amendments override the corresponding sections in the Declarations.

On 27 JUN 2022, the Community Standards were amended.  The amendment can be found here.

Enforcement

Enforcement of the community standards is the responsibility of the Landscape Maintenance Sub Committee (LMSC) of the Architectural Control Committee (ACC) and the Hamptons property manager.  Any violation will result in a letter stating the nature of the violation and a period of time in which the violation must be corrected.

Property Exterior Modifications

Modification to a residential building exterior or landscape requires review and approval by the Architectural Control Committee(ACC) before any modifications are made to the property. The ACC will review the homeowner's requested modifications to ensure any changes are consistent with the Declaration of Covenants and Restrictions for The Hamptons. Approved house color can been viewed through Sherwin Williams:  Approved House Colors.   You may use any paint company which can match the approved colors.

Landscaping

The Hamptons HOA contracts a third party company to maintain the landscaping in the Common Areas and the South Village.  Residents of the North and West Villages are responsible for maintaining their individual landscaping.  As a reminder, ACC approval is required before making any landscape modifications.

The Hamptons' Board of Directors has approved the use of mulch, that meets the following specifications, throughout The Hamptons. Mulch Specification This mulch is available at Big Earth Landscape Supply .  However, you are free to purchase an equivalent mulch from different supplier.

Mailboxes and Yard Lights

All property owners are responsible for the maintenance and operation of their mailbox and yard light.  All Mailboxes and Yard Lights MUST remain consistent in style and colors throughout the entire Hamptons community. Waste and Recycling Containers

Garbage cans, recycling bins, bulk waste, construction, landscape supplies or other similar articles shall be stored so as to not be visible from outside the home.  Waste receptacles and landscaping waste should be placed curbside no earlier than 5:00 pm on the day before collection.  Empty bins should be properly stored no later than dusk on the day of collection.

Backflow Prevention

Sarasota county requires Cross Connection Control /Backflow Prevention testing and maintenance by all homeowners.  The testing frequency ranges from two years to ten years depending on the type of backflow preventer that is required by the utility.  Residents are notified by Sarasota County when testing is required. Testing and needed repairs/replacements must be done at the owner’s expense by a licensed contractor of their choosing.

Whole House Generator Installation

Installation of a whole house generator must comply with Sarasota County requirements and requires a permit from the County.  See here for additional requirements.
